This is for all who showed me their support for my missing 3 year old nephew, and to let all know that it was all appreciated, and to let you all know that prayers are answered. We thank you all for showing your support on this for us. Thank you all from the bottom of my heart.
We found my nephew safe and okay, and his grandmother too. But we now have a whole new problem, the Alabama State DHR has placed my nephew in a foster home, and have not contacted us at all to see if he had any family.
This is the update for all, my brother and I found my nephew and his grandmother, she had a diebitic siezeure, and was hospitalized, thanks for the unknown person for calling the ambulance, but now we have a new dilema, for reasons that are not fathomable, a overzealous DHR ( Department of Human Resources) Took it upon herself to put him in a foster home, without ever contacting any family. He had his meds with him with the address and info in it to contact his family, and his grandmother had emergency contact info on her and in her purse. The DHR woman said she couldn't contact any family and that is why she placed him in the foster home. I never got any calls, neither did my brother. The only time we found out where he was, is when we put out a regional Amber Alert for my nephew. And Alabama had him in custody that morning, and never contacted us, we are now looking into a lawsuit against them, being a DHR worker in Ga said they couldn't place him in a foster home till we were contacted and only could place him there till we got there to collect him, as it stands now we have to return on Monday morning for a hearing on who can get my nephew.
Now you all tell me if there isn't something wrong with this picture. The Town in question on this whole issue is one of the most famous NASCAR towns where they race, Taledega.

Any comments I make on the complete idiocy of what I have just read would be nothing more than drunken banter.
I guess it wouldn't be too far off what you are already encountering. Perhaps you should take a breathalizer with you next time you visit the DHR.
Sorry to hear the beuraucracy of moderm society is as brutal as it was imagined.

What? my comment? or how Alabama is handling things? If it is Alabama's way of doing things then you are right on their idiocy.

The only thing I hate in all this is the court fees, and having to prove that my brother and my nephew's mother are my nephews parents. It is going to cost them almost all they have saved up to buy my nephews christmas, to pay for all things to try and get him back, hopefully for christmas. I am already getting my nephews christmas presents for him for my brother and his son's mother, so they don't have to worry that my nephew doesn't have a christmas to come home to. Oh, by the way my nephew's name is Shaun. He is usually a very happy and adventurous child, and full of playfull mischief, I hope this experience doesn't scar him mentally.
Well that is enough of my rantings and ramblings on my nephews plight.
But thanks for all with their support.

Tell me about it Loc, I hope it all goes well tomorrow, going to leave tonight to be there in the morning for the custody hearing, which I still think is a load of crock, I think it is Alabama's way to make a few bucks off our misery. Jeez the things some of the states will stoop to to make a buck.

well we are close to Taledega Alabama, we are going to get a room, and I will let all know how the court went on getting my nephew back. nite all gotta go now we are pulling into Taledega as I type. I love this centrino tech, hehe. well I gotta go all. Wish us luck.

Sorry this is late, the grandmother is doing okay, and Alabama has decided they want to keep my nephew in their illustrious foster homes. And that sux bigtime too. I really want to rip someones throat out at the moment, but we are talking to a lawyer and looks like we may have a nice lawsuit on our hands if we play things right, and we have to get him home first to make the lawsuit work. wish us luck well I gotta go now, going to meet the lawyer dads friend arranged for us to see. later all.

Good luck, I hope things work out for you.
Try suing the individuals who were too stupid to read the pill bottles or the emergancy contact in the Grandmother's purse. Such sloppy and incompetant social work is surely a crime. Sue for court costs, emotional damages, psychological damages, the grandmother's hospital bill, and others I am sure a lawyer can tell you more about what you can sue for. Keep track of your expenses incurred while trying to get him back, keep all receipts, even gas receipts.
Go to the media as well, present them with the evidence you have and names and numbers of the government workers involved. In Saint Louis, Missouri we have a "You paid for it" on our Fox station News Program that investigates government waste and incompetence. See if one of the local news channels offers that as well. Nothing like going public with it to get those wheels of the DHR system turning to get your nephew back.

LOL. Punitive damages or tort things like "emotional distress" are usually reserved for private parties. Most gov't-related "financial awards" have to be approved by a judge first (even if a jury awards it) and Appeals will almost always knock it down. Hunting for money damages makes a person look greedy since the public coffer equals taxpayer dollars. If you have an attorney that advises you seek financial awards beyond cost (legal fees) then you really should get a better attorney. Rather than looking for money you might wanna look for simple injunctive relief to forbid DHS from holding the child... it's usually quicker since a good attorney will get custody returned back to the parents pending any appeals. Caveat IANAL: I am not a lawyer, this is not legal advice, seek counsel before taking any action, never act on the advice of someone on the internet.
Public attention here can definately help, taking a child from his/her family at Christmas time because of some overzealous vendetta is a highly emotional event. If you can't get local coverage you can submit a press release to a public newswire service for a donation of like $50... something I'm sure people would chip in for. There are also several fax-based editorial submission lines, you can simple draft a press release and fax it in. CNN.com also has a "write the editor" email address and news sites are always desperate for good content... making this a bit easier. Failing that, submit your story to blog sites. There are several "family first" theme blogs as well as "liberal" humanitarian blogs that would run this story in a heartbeat... which just might attract the attention of someone in a more official position.

I only studied Employment Law.
I used to work for lawyers for four and a half years as a programmer, though. I've had enough with lawyers for my life-time, to tell you the truth. They unjustly fired me due to my mental and physical illnesses, or at least their managers and HR department did.

Well that is why I said sue the people and not the government, who made the mistakes. I thought it was like suing a doctor who botched up surgery rather than the hospital. So you mean to tell me that people who work for the government cannot be sued? Which means all those women who sued Bill Clinton for damages because they claimed he sexually harassed them while he was working for the government had no case?
